Starting a food business in India requires navigating a multi-layered regulatory framework designed to ensure food safety, public health, and legal compliance. The primary authorities include the Food Safety and Standards Authority of India (FSSAI) under the Ministry of Health, the GST authorities under the Ministry of Finance, and state-specific departments for Shop and Establishment registration, trade licenses, health approvals, and fire safety. Depending on the nature and scale of the business whether it is a cloud kitchen, restaurant, food truck, catering service, bakery, or packaged food brand different licenses and registrations apply. The compliance journey begins with registering the business structure, followed by obtaining the FSSAI license, GST registration, Shop and Establishment registration, Trade License, Fire NOC, and other ancillary approvals. The FSSAI license is the most critical requirement for any food business in India. The Food Safety and Standards Act 2006 mandates that every Food Business Operator must obtain an FSSAI license or registration before commencing operations. There are three categories based on the scale of operations. FSSAI Basic Registration is for small businesses with annual turnover up to Rs. 12 lakhs and production capacity not exceeding 100 kg or liters per day. FSSAI State License is for medium businesses with turnover between Rs. 12 lakhs and Rs. 20 crores operating within a single state. FSSAI Central License is for large businesses with turnover exceeding Rs. 20 crores, importers, exporters, multi-state operators, and e-commerce sellers.

GST registration is mandatory for food businesses with aggregate turnover exceeding Rs. 40 lakhs (Rs. 20 lakhs for special category states). However, restaurants and cloud kitchens operating through platforms like Zomato and Swiggy must register regardless of turnover. Businesses engaged in inter-state supply must also register. The GST rate varies by category: restaurants and catering services without accommodation attract 5 percent GST without input tax credit, while hotels with room tariffs of Rs. 7,500 and above attract 18 percent GST. Packaged food items are taxed at 5 percent or 12 percent depending on the category. Registration is processed within 7 to 15 working days through the GST portal. Once registered, businesses must file GSTR-1 by the 11th and GSTR-3B by the 20th of each month or opt for the QRMP quarterly scheme if eligible.
Shop and Establishment registration is a state-level requirement governed by the respective Shops and Establishments Act of each state. It applies to all commercial establishments including restaurants, food outlets, bakeries, and cloud kitchens. The registration regulates working hours, overtime, weekly holidays, employee wages, and leave policies. Registration must be obtained within 30 days of commencing business. Required documents include business address proof, PAN, identity proof of the owner, and employee details. The certificate is valid for one to five years depending on the state. Many states including Maharashtra, Delhi, Karnataka, and Tamil Nadu offer fully online application and renewal facilities making the process significantly easier.
A Fire NOC from the State Fire Services Department is mandatory for food businesses involving cooking operations and use of LPG or flammable materials. It certifies compliance with the National Building Code's fire safety norms. Requirements include fire extinguishers, emergency exits, smoke detectors, fire alarms, proper ventilation, and fireproof kitchen hoods. The application requires building plans, occupancy certificate, fire safety equipment details, and compliance declaration. The Fire NOC is valid for one year and must be renewed annually with a fresh inspection. Businesses without a valid Fire NOC face fines up to Rs. 1 lakh and potential closure orders in case of incidents.
A Trade License is issued by the local municipal corporation for operating any business within its jurisdiction. For food businesses, it confirms that the premises meet health, safety, and sanitation standards. Categories include eating houses, restaurants, food stalls, bakeries, sweet shops, and food processing units. The application requires FSSAI license, building plan approval, health department NOC, and municipal tax payment proof. Annual fees range from Rs. 1,000 to Rs. 25,000 depending on the city and business category. Operating without a Trade License can lead to fines, sealing of premises, and prosecution under the Municipal Corporation Act.
Additional licenses may be required based on the nature of the food business. A Health Trade License from the local health department is mandatory with medical fitness certificates for all food handlers. A Factory License under the Factories Act 1948 is required for manufacturing units employing 10 or more workers with power or 20 or more without power. BIS license is required for certain packaged food categories. An LPG storage license from the District Magistrate is needed for businesses using large quantities of LPG. A liquor license from the state excise department is required if serving alcoholic beverages. Weights and Measures registration is needed for packaged food sellers. Trademark registration is recommended to protect the brand name and logo. For home-based food businesses, a Home Food Business License under FSSAI regulations is now mandatory with specific kitchen hygiene compliance norms.
