Common GST errors that lead to penalties, scrutiny, and notices from the department. Expert tips to stay compliant and penalty-free.

10 GST Mistakes Indian Businesses Make (And How to Avoid Them)

1. Failing to Reconcile ITC with GSTR-2B

Many businesses claim ITC without verifying supplier return filing. Rule 36(4) restricts ITC to GSTR-2B amounts. Unreconciled claims attract demand notices with 18% interest and penalties up to 100% of tax. Reconcile monthly after the 14th.

2. Using Incorrect HSN or SAC Codes

Wrong codes lead to incorrect GST rates and ITC mismatches. Minimum 4-digit HSN for turnover up to Rs. 5 Crore, 6-digit above. Maintain updated HSN master and audit code usage.

3. Ignoring E-Invoicing Compliance

Mandatory for turnover above Rs. 5 Crore. Generate e-invoices on IRP with IRN and QR code. Penalty: Rs. 10,000 per invoice under Section 122. Integrate accounting with IRP via API.

Tip:

E-invoicing is real-time reporting through the IRP, not just electronic generation. B2C invoices do not require e-invoicing.

4. Not Filing Nil Returns

Must file even with no activity. Nil non-filing accumulates late fees and risks registration suspension under Section 29. Most platforms offer one-click nil filing.

5. Issuing Non-Compliant Invoices

Invoices must include unique serial number, GSTIN, HSN/SAC, taxable value, GST rate, place of supply, signature. Missing fields cause ITC denial for buyers.

6. Ignoring Reverse Charge Liability

RCM shifts liability to recipient. Common: unregistered dealer purchases, GTA services, legal services, director remuneration. Pay via GSTR-3B and claim ITC simultaneously.

7. Late Filing of Returns

Penalties: Rs. 50/day for GSTR-1/3B, Rs. 200/day for GSTR-9, plus 18% interest. Chronic lateness blocks e-way bills and risks cancellation. Use compliance calendars.

Monthly Filing

Turnover above Rs. 5 Crore. GSTR-1 due 11th, GSTR-3B due 20th.

QRMP Scheme

Turnover up to Rs. 5 Crore. Quarterly returns, monthly PMT-06 payment.

8. Wrong Supply Classification

Incorrect intra vs inter-state classification causes CGST/SGST vs IGST errors. Stock transfers between states attract IGST. Auto-determine based on buyer location.

9. Missing ITC Claim Deadline

ITC must be claimed by September 30 under Section 16(4). Forfeited if missed. Begin annual prep by July.

10. Not Updating GST Registration

Changes must be updated within 15 days under Section 28. Penalty under Section 122 for incorrect particulars. Keep a change log.
